THANK YOU, MADAM MAYOR. MEMBERS OF THE COUNCIL, AS YOU KNOW, STAFF IS TRYING WITH EVERYTHING THAT THEY CAN TO MAKE THIS THE LAST MEETING THAT YOU HAVE IN THIS COUNCIL CHAMBERS. BUT IT'S A COMPLICATED ROAD TO GET THERE.

AND PART OF THAT RELATIONSHIP WITH OUR DEVELOPER AT THE NEW LOCATION IS A CONDO AGREEMENT.

SO THE CITY WILL OWN THE CITY HALL CONDO.

AND TO GET TO THAT POINT, WE'VE GOT A LOT OF LEGALESE TO GET THROUGH UNDERLYING TITLE ISSUES, REGISTRATION OF A COMPLICATED PLAT, ETCETERA.

SO THERE'S SOME DELAYS IN GETTING TO THAT POINT WHERE THE CITY CAN ACCEPT THE TRANSFER OR CONVEYANCE OF THE THE CONDO PROPERTY TO THE CITY.

IN 2022, WE EXECUTED AN EARLY ACCESS AGREEMENT THAT ALLOWED THE CITY TO MOVE IN AND COMMENCE CONSTRUCTION BEFORE OWNERSHIP.

AND NOW THAT BUILD OUT IS COMPLETE AND THE CITY IS READY TO TAKE OCCUPANCY AND MOVE INTO THE BUILDING.

AND WE STILL HAVE UNDERLYING TITLE ISSUES THAT ARE WORKING IN THE BACKGROUND.

SO WHAT IS IN FRONT OF YOU IS A MOVE IN AGREEMENT WHICH IS VERY CLOSE TO THE SAME LANGUAGE AS THE EARLY ACCESS AGREEMENT WITH SOME TWEAKS THAT ACTUALLY PROVIDE FOR OCCUPANCY AND OPERATIONS.

THE PACKET THAT WAS DISTRIBUTED TO YOU HAD AN AGREEMENT THAT YOU RECEIVED OVER THE WEEKEND AND THERE WAS A SIGNIFICANT CHANGE THAT WE THOUGHT WE NEEDED TO PULL THIS TO DISCUSS. IT'S ON PAGE THREE OF THE AGREEMENT THAT WAS PASSED OUT, PARAGRAPH FOUR, AND IT'S TITLED RENT.

BUT IN THE CASE OF THIS ARRANGEMENT, IT'S NOT RENT IN THE TRADITIONAL SENSE.

WHAT WE WOULD BE PAYING HERE UNDER THIS CHANGE WOULD BE THE HOA DUES THAT WE WOULD TYPICALLY BE PAYING IF WE TOOK FULL OCCUPANCY AS OWNER AND THEN THE PROPERTY TAXES THAT WOULD ALSO BE DUE.

SO IT'S CONSISTENT WITH THE ALREADY IN PLACE TRANSFER AGREEMENT FOR COSTS THAT THE CITY WOULD BE LIABLE FOR ONCE WE TOOK OCCUPANCY AND OWNERSHIP. THIS IS THAT MOVE IN PERIOD WHICH CARRIES THE SAME COST BURDEN.

SO THAT PROVISION NEEDED TO BE DISCUSSED AND ARTICULATED WITH THE LATTICE WE WORKED THROUGH OVER THE WEEKEND AND THEN THIS MORNING TO TO TO COME TO TERMS. AND THAT IS THE MOST SIGNIFICANT CHANGE THAT WE WANTED TO DISCUSS WITH THE COUNCIL RATHER THAN LEAVING IT ON CONSENT.

AND THIS HAS BEEN LOOKED AT WITH OUR CITY ATTORNEY.

SO IT IT DOES NOT SAY HOA IN THE PARAGRAPH.

SO I JUST WANT TO MAKE SURE. OH, CORRECT.

YEAH. I'VE REQUESTED THIS ITEM BE REMOVED FROM THE CONSENT AGENDA BECAUSE I STRONGLY BELIEVE THAT THE ISSUE SHOULD BE FULLY TRANSPARENT TO THE VOTERS.

AND EVEN THOUGH IT'S NOT MANDATED TO BE A PUBLIC HEARING, IT WAS INITIALLY PRESENTED AS ONE, AND I BELIEVE IT SHOULD HAVE REMAINED SO IN LIEU OF THE LACK OF A SECOND PUBLIC HEARING, I'D LIKE TO SHARE THE FOLLOWING WITH YOU.

THIS CONCERN WAS BROUGHT FORWARD BY COUNCIL MEMBER JAMES.

IT IS HER CONTENTION THAT BECAUSE CAMPAIGNS HAVE BECOME SO COSTLY AND THE CURRENT PAY SCALES SO LOW AND WITHOUT ANY ADJUSTMENT FOR DECADES, ONLY THE ULTRA WEALTHY AND RETIRED CAN OR WILL RUN FOR OFFICE LIMITING EQUITABLE REPRESENTATION.

I CANNOT DENY THE 2020 INCREASE IN CAMPAIGN COSTS OR THE LACK OF SALARY ADJUSTMENT FOR 30 YEARS.

BUT NO MATTER HOW WELL INTENDED, WE SHOULD NOT ATTEMPT TO ALLEVIATE ONE PURPORTED BIAS BY CREATING ANOTHER.

AS I LOOK AT MY CONTEMPORARIES AT THE DAIS, I MIGHT ASSUME SOME ARE MORE FINANCIALLY COMFORTABLE THAN OTHERS, BUT WOULD NOT CLASSIFY ANY AS WEALTHY OR ESPECIALLY ULTRA WEALTHY AS IS BEING SUGGESTED.

IN FACT, THIS AND PREVIOUS COUNCILS SERVE AS EVIDENCE TO THE CONTRARY OF COUNCIL MEMBER.

A PREVIOUS WORK SESSION DISCUSSION INCLUDED COUNCIL MEMBER BISKIND'S COMMENT THAT OUR POSITIONS ARE PRIMARILY SEEN AS A SERVICE TO THE COMMUNITY.

NOT ONLY DO I AGREE WITH THAT NOTION, BUT I WOULD ALSO NOTE THAT OUR $7,800 ANNUAL SALARIES ARE NOT NECESSARILY DESCRIPTIVE AS A PAYCHECK AS WE MIGHT THINK IN A CONVENTIONAL SENSE.

I DO NOT DENY THAT THE COUNCIL SALARIES MUST BE ADJUSTED, BUT WE SHOULD NOT CORRECT 30 YEARS IN ONE LARGE SWEEP WITHOUT THOUGHT FOR THE TAXPAYERS OF COLUMBIA HEIGHTS.

CONSIDERING THE LACK OF POSSIBLE COLA LANGUAGE OR A SPECIFIC SCHEDULE FOR FUTURE SALARY INCREASES OR THE CONSIDERATION OF THOSE INCREASES, I WOULD ENCOURAGE THE COUNCIL TO FIRST SEND THIS ISSUE TO THE CHARTER COMMISSION WITH RECOMMENDATIONS FOR AMENDMENT.

SO UNFORTUNATELY, THIS ONE HAS NOT BEEN INSPECTED, BUT IT HAS BEEN INSTALLED.

AND I HAVE THE CONTRACTOR HERE WHO'S INSTALLED IT AND WE HAVE VIDEOS AND PICTURES.

AND SO NUMBER TWO WAS THE FOUNDATION WALL.

NOW, THIS ONE DID SERVE THE PURPOSE AS FAR AS THE THE THE CODE, THE CITY CODE 58203.

IT DID HE DID REPLACE THE BROKEN CRUMBLING BLOCKS IN FRONT OF THE PATIO AND IT DID IN SUCH A CONDITION THAT WOULD PREVENT ENTRY OF RODENTS AND OTHER PESTS. BUT THE WORKMANLIKE I GUESS IT'S NOT YOU KNOW, PRETTY ENOUGH OR IT NEEDS TO BE SMOOTHED OUT.

SO THE FIRST ONE, THE SEGMENT THAT IS INCLUDED WITH THIS PARTICULAR PROJECT GOES FROM THE MEDTRONIC PROPERTY TO THE WEST FOR COLUMBIA HEIGHTS, IT ENDS AT UNIVERSITY, BUT THE OVERALL PROJECT ACTUALLY GOES ALL THE WAY OVER TO MAIN.

THIS WORK INVOLVES THE RECONSTRUCTION OF THE ROADWAY, NARROWING THE ROADWAY BY TEN FEET AND THEN INTRODUCING A TRAIL ON THE SOUTH SIDE OF THE ROADWAY AND INTRODUCING A SIDEWALK, CONCRETE SIDEWALK ON THE NORTH SIDE OF THE PROJECT.

SO BIDS ARE ADVERTISED BY THE CITY OF FRIDLEY.

THEY ARE THE PRIME ON THIS.

IT'S A JOINT PROJECT BETWEEN FRIDLEY AND COLUMBIA HEIGHTS.

THEY WENT THROUGH THE PUBLIC BIDDING PROCESS.

THEY RECEIVED FOUR BIDS, AND THEN THE LOW BID CAME IN FROM PARK CONSTRUCTION COMPANY, VERY PLEASED, AND THAT THE LOW BID CAME IN 15.5% UNDER THE ENGINEER'S ESTIMATE FOR THE WORK.

THIS WORK FOR THE CITY SIDE WOULD BE FUNDED THROUGH THE GRANT THAT WE JUST ACTUALLY AWARDED EARLIER IN TODAY'S AGENDA.

AND THAT'S THE RIP OR THE LOCAL ROAD IMPROVEMENT PROGRAM GRANT, AND THAT'S SHARED BETWEEN FRIDLEY AND COLUMBIA HEIGHTS.

AND THEN FOR US, IT WOULD BE THROUGH ASSESSMENTS, BOND FUNDS AND THEN ALSO OUR STATE AID ACCOUNT.

WE DO HAVE WATER MAIN REPLACEMENT ON THE COLUMBIA HEIGHTS SIDE OF THIS, AND THAT'S WHERE A WATER MAIN HAD CRACKED ABOUT TWO YEARS AGO AND IT'S JUST BEEN OUT OF SERVICE EVER SINCE DUE TO ITS SHALLOW DEPTH.

THE PRIMARY ASPECT OF THIS PROJECT IS INTRODUCING SAFETY IMPROVEMENTS ON 53RD AVENUE RAISED CONCRETE MEDIAN FROM CENTRAL OVER ACTUALLY THE ENTIRE DISTANCE FOR THIS PROJECT OVER TO THE TURNABOUT.

THE TURNABOUT IS BASICALLY A ROUNDABOUT, BUT IT DOESN'T HAVE A NORTH SOUTH LEG.

IN THIS CASE, IT'S REALLY USED FOR A TURNAROUND FOR PEOPLE GOING FROM ONE DIRECTION OR THE OTHER DIRECTION ON 53RD AVENUE.

AND THEN AGAIN, THIS PROJECT ENDS AT THE WHAT WOULD BE REALLY THE WEST ENTRANCE FOR EITHER TARGET ON THE NORTH OR MEDTRONIC ON THE SOUTH SIDE.

IT DOES INCLUDE NEW SIDEWALK ON THE NORTH SIDE AND A NEW TRAIL PAVED TRAIL ON THE SOUTH SIDE, WHICH WOULD BE IN COLUMBIA HEIGHTS.

THIS ONE, THE LOW BID DID COME IN ABOUT 5% OVER THE ENGINEER'S ESTIMATE.

I WOULD NOTE FOR THIS THAT WE DO HAVE GRANT FUNDING AND THE GRANT FUNDING AS PART OF THIS HAS BEEN HAS HAD A SLIGHT INCREASE FOR THAT.

SO THAT OVERAGE WILL BE COVERED BY THOSE GRANT FUNDS FOR THE BOTH CITIES.

ACTUALLY WITH THAT, THE ONLY UNFORTUNATE THING FOR US IS THAT IT'S TWO DIFFERENT CONTRACTORS.

I SIGNED ON TO A LETTER TO THE EPA AGENCY OF THE FEDERAL GOVERNMENT BECAUSE OF THE PROTECTIONS THAT ARE BEING TAKEN AWAY FROM CITIES.

SO OTHER LOCAL GOVERNMENT LEADERS ARE SIGNING THAT LETTER TO ENSURE STRONGER ENVIRONMENTAL PROTECTION.

WE HAD A LONG COUNCIL WORK SESSION LAST WEEK AND WE GOT A LOT OF CONVERSATION DONE.

WE DID OUR ADOPT A PARK THIS WEEK OF OSTRANDER PARK AND IT WAS FAIRLY CLEAN EXCEPT FOR A LOT OF FIREWORKS TRASH.

AND SO THE MAYOR WAS ON ONE ZOOM CAMERA.

THEY HAD A CAMERA IN THEIR ROOM.

SO THERE WERE SOME PEOPLE IN THE AUDIENCE HERE WHO WERE THERE AT THE EVENT.

IT WAS SO MUCH FUN BECAUSE WE HAD A CAMERA WITH A MEETING ROOM THERE WITH ABOUT 30 PEOPLE.

WE HAD ABOUT 30 PEOPLE WITH OUR ROOM WITH A CAMERA ON IT.

AND ALL THE WAY IN SOMALIA, THERE WAS A YOUNG MAN FROM MINNESOTA, A 22 YEAR OLD MAN WHO WAS THERE, AND HE SAID HE JUST WAS HAVING THE MOST WONDERFUL TIME.

IT WAS SUCH A SAFE PLACE.

AND ALSO THE SISTER CITY SIGNING TODAY, SECOND, THIRD, FOURTH AND FIFTH GRADERS FROM VALLIVUE SCHOOL CAME OUT FOR THEIR ENVIRONMENTAL SCHOOLING AND HUNG OUT AT OUR BLOOMING SUNSHINE GARDEN.

THEY MET WITH LIAM GARDNER.

OUR OUR CITY FORESTER LEARNED ABOUT TREES AND.

AND I GAVE THEM A TOUR OF THE GARDEN AND WE TASTED MANY, MANY HERBS, CHIVES, THYME, MINT, SAGE, WHICH DOESN'T TASTE GOOD DILL, BUT THEY GOT TO TRY LOTS OF THINGS.

IT WAS A LOT OF FUN. AND TOMORROW NIGHT IS OUR YOUTH BOOK CLUB AT THE LIBRARY.

I HAVE HEARD VERY LOUDLY AND CLEARLY EVERY SINGLE DAY THAT COUNCIL MEMBER JACOBS DOES NOT EMBODY COLUMBIA HEIGHTS AND THAT LEARNING THAT AND SEEING THAT VERY DEEPLY HAS BEEN THE BEST THING THAT I HAVE DONE SINCE I MOVED TO THIS CITY ALMOST EIGHT YEARS AGO.

SHE DOESN'T DESERVE TO REPRESENT ANY OF US.

HER BEHAVIOR TO COUNCIL MEMBER SPRIGGS AND IN THE AFTERMATH OF THE NOW INFAMOUS INCIDENT IS UNACCEPTABLE TO THIS COMMUNITY.

AND NOW WE CAN COLLECTIVELY CELEBRATE THAT THIS DARK CHAPTER IS COMING TO AN END AND WE ARE MOVING FORWARD.

I'M NOT GOING TO RECITE THE WHOLE LETTER TO EVERYBODY HERE.

YOU GUYS ALL RECEIVED A COPY OF IT EARLIER, BUT I'M GOING TO READ A FEW THINGS AT LEAST TO OUTLINE THE PERTINENT LAW IN THIS AREA AS IT APPLIES TO THE RECALL EFFORT AND TO NOTIFY YOU THAT IF YOU DO ORDER PLACEMENT OF THE QUESTION ON THE MUNICIPAL BALLOT, WE WILL FILE SUIT AGAINST THE CITY AND LITIGATE THE MATTER IN THE COURTS.

YOU'VE SEEN THE SAMPLE SIGNATURE PAGE FROM THE RECALL EFFORT AGAINST MY CLIENT, AS WELL AS THE CERTIFICATE OF THE ORIGINAL SPONSORING COMMITTEE.

SO PLAINLY THE EFFORT BY THE RECALL COMMITTEE IS WOEFULLY INADEQUATE IN SEVERAL REGARDS.

FIRST, THE ADMINISTRATIVE RULE REQUIRES THAT THE SIGNERS OATH AND THE SIGNATURE LINES BE ON THE SAME SIDE OF THE PAPER.

EACH PETITION PAGE HAS TO HAVE A SIGNERS OATH AND NO SMALLER THAN 12 POINT FONT.

IF THE FORM OF THE OATH IS NOT SPECIFIED BY STATUTE, THEN THE RULE SPECIFIES THE OATH THAT'S TO BE USED IN THE COLUMBIA HEIGHTS RECALL EXAMPLE, THE COMMITTEE HAS FAILED TO INCLUDE A SIGNATURES SIGNERS OATH RATHER AT ALL IN ANY REGARD, MUCH LESS ABIDING BY THE 12 POINT FONT REQUIREMENT. SECOND, THE RULE MANDATES THAT EACH PETITION PAGE HAS TO INCLUDE THE FOLLOWING STATEMENT IMMEDIATELY ABOVE THE SIGNATURE LINES.

ALL INFORMATION HAS TO BE FILLED IN BY PERSON SIGNING THE PETITION UNLESS DISABILITY PREVENTS THEM FROM DOING SO.

ONCE AGAIN, IN THIS EXAMPLE, THE STATEMENT HAS BEEN OMITTED FROM THE PETITIONS ALTOGETHER.

THIRD, THE RULE DICTATES THAT CERTAIN INFORMATION IS INCLUDED IN THE SIGNATURE LINES THEMSELVES.

NAMELY, EACH LINE HAS TO HAVE A SPACE FOR THE DATE OF THE SIGNATURE, THE SIGNATURE ITSELF, AND EACH SIGNATORIES YEAR OF BIRTH PRINTED FIRST, MIDDLE AND LAST NAME, RESIDENCE, ADDRESS, MUNICIPALITY AND COUNTY.

THERE ARE MULTIPLE PROBLEMS HERE AS WELL.

PROBABLY THE MOST SIGNIFICANT OF THESE IS THE FAILURE OF THE PETITIONERS TO PROVIDE ANY SPACE FOR THE DATE THE SIGNATORIES SIGNED THE PETITION.

THIS BY ITSELF RENDERS THE SIGNATURES INVALID FOR TWO REASONS, NOT ONLY BECAUSE IT FAILS TO COMPLY WITH THE ADMINISTRATIVE RULE, BUT ALSO BECAUSE IT MAKES COMPLIANCE WITH THE CITY CHARTER IMPOSSIBLE.

NEXT, THE YEAR OF BIRTH IS REQUIRED OF ALL SIGNERS UNDER THE ADMINISTRATIVE RULE.

THIS, TOO IS MISSING FROM EACH LINE ON THE SIGNATURE PAGES, AS IS IS THE SIGNERS COUNTY OF RESIDENCE.

THE FINAL OBVIOUS DEFECT CONCERNS THE STATEMENT REQUIRED TO BE INCLUDED BY A SUBPART TWO I ALL INFORMATION IS SUBJECT TO PUBLIC INSPECTION.

THIS TOO IS MISSING FROM THESE DOCUMENTS AND COULD WELL HAVE HAD SIGNIFICANT IMPACT ON A DECISION TO SIGN THE DOCUMENT OR NOT.

BUT THESE SHORTCOMINGS ARE REALLY ONLY THE BEGINNING OF THE PROBLEMS WITH THESE PETITIONS.

EVEN IF WE IGNORE THE FACIAL DEFECTS, THE PETITION EFFORT FAILS FOR A MUCH MORE SIGNIFICANT REASON.

THE MINNESOTA CONSTITUTION AT ARTICLE EIGHT, SECTION FIVE, CLARIFIES THE LEGISLATURE OF THIS STATE MAY PROVIDE FOR THE REMOVAL OF INFERIOR OFFICERS FOR MALFEASANCE OR NONFEASANCE IN THE PERFORMANCE OF THEIR DUTIES.

THESE ARE NOT ARBITRARY TERMS. COLUMBIA HEIGHTS IS NOT INSULATED FROM THESE PROVISIONS BY VIRTUE OF ITS STATUS AS A CHARTER CITY TO CONSTITUTE MALFEASANCE OR NONFEASANCE.

AS THE MINNESOTA SUPREME COURT HAS HELD, THE CONDUCT MUST BE SUCH AS AFFECTS THE PERFORMANCE OF OFFICIAL DUTIES RATHER THAN CONDUCT, WHICH AFFECTS THE OFFICIAL'S PERSONAL CHARACTER AS A PRIVATE INDIVIDUAL.

MALFEASANCE IN AN OFFICIAL CAPACITY HAS REFERENCE TO EVIL CONDUCT OR AN ILLEGAL DEED, AN ACT BY AN OFFICER IN OFFICIAL CAPACITY THAT IS WHOLLY ILLEGAL AND WRONGFUL.

THE SUPREME COURT DREW A LINE BETWEEN POLITICAL CRITICISMS WHERE RECALL MAY NOT BE INVOKED AND MALFEASANCE WHERE IT CAN.

IN SHORT, THE RECALL EFFORT AGAINST COUNCIL MEMBER JACOBS FALLS WOEFULLY SHORT OF MALFEASANCE UNDER THE COURT'S DEFINITION.

AND SIMPLY PUT, THE GROUNDS FOR RECALL ARE POLITICAL CRITICISMS THAT MAY BE ADDRESSED AT THE NEXT ELECTION.

SHOULD COUNCIL MEMBER JACOBS CHOOSE TO RUN AGAIN? THE ENTIRE EFFORT TO RECALL COUNCIL MEMBER JACOBS IS HOPELESSLY FLAWED AND FACES CERTAIN DEFEAT IN THE COURTS.

IN THE ABSENCE OF AN OUTRIGHT REJECTION OF THE RECALL PETITION.

I WOULD SIMPLY URGE THE MAYOR AND COUNCIL TO WAIT ON MAKING THE FINAL DECISION ON THE LEGAL VALIDITY UNTIL AFTER YOU'VE HAD THE OPPORTUNITY TO REVIEW THE PERTINENT LAW WITH YOUR LEGAL COUNSEL.

THE STATUTORY DEADLINE FOR NOTIFYING THE COUNTY AUDITOR AND SECRETARY OF STATE OF A HOLDING OF A SPECIAL ELECTION IS 74 DAYS BEFORE NOVEMBER 7TH, WHICH IS AUGUST 25TH.

THAT MEANS YOU HAVE PLENTY OF TIME TO DECIDE AT A LATER DATE WHETHER TO CALL THE ELECTION IN SPITE OF THESE OBVIOUS DEFICIENCIES IN THE PETITIONS.
